Pa​ternity Actions

A Paternity action can be initiated by either the father or the mother of a child. Paternity actions begin by filing a Petition. Temporary Orders can also be addressed with a proper Application with the Court. Are you a mother or father of a child that you have been denied access to? Are you in need of child support from the other parent of your child? Has your baby been born yet? These are all questions to address in a consultation. ​Visitation and Custody

Visitation and Custody issues  arise in Paternity actions much like they do in a divorce action.  However, there is some unique case law that has developed in Paternity actions over the recent years as it relates to these two issues. Uniform Parentage Act 43 O.S. §7700 et seq.

The UPA addresses issues relating to the Paternity of a child, who has rights to the child, as well as the rights of the child. Further provided is guidance to genetic testing, child support, and the establishment of a mother-child and father-child relationship. One very significant part of this act is the two (2) years statutory time limitation to object to an adjudicated or acknowledged father of the child.  If these issues raise concerns for you, please call to set up a consultation.
